I let my cousin borrow my car Halloween night. He gets pulled over because the cop says aftermarket exhausts are illegal in the state of VA. Which isn't true according to the laws I have read. All I did was replace the muffler on my Neon so it's not a noise issue. I have had it on for years and have never failed inspection. I have been pulled over 3 times in it for other reasons and the cop never mentioned anything about the exhaust. To me it was obvious since it was late at night and Halloween he was looking to bust people for DUI. I know some of you are police/former police, so is it legal for a cop to make up a law to pull you over?
I don't really have a problem with it, just wish he would have been honest about the situation.
As a a side note my cousin passed the field sobriety and breathalyzer test with flying colors.

if he gave the kid a ticket for it yes, thats illegal and a problem
otherwise he felt the need to pull him over and couldnt find one so he made one up, its a common practice, normally the "offender" winds up with just a DUI or OVI (happened to my buddy, cop said his LP light was out {it was btw}) and the original "offense" never makes it to the report
i got pulled over because it was 2 AM and i was doing the speed limit
actually funny happened to me twice lol

yeh as long as he didn't get a ticket or anything he is pretty much allowed to do it...
i know here in CO you can't modify the exhaust in any way shape or form but its not an offense that you can get pulled over for, however you can get that ticket tacked on to the other ones you might have gotten

If aftermarket exhausts are in fact illegal, then that basically means if it isn't stock, then it's illegal. I would also say that is a big "no" for a cop to make up a law to pull you over, they won't lie to you as to why they pulled you over either as there is no reason to and they can lose their job. If you are 100% positive the officer made an honest mistake, go back and check the laws. If he didn't receive a ticket for it then don't worry about it, but check the laws to make sure you don't get pulled over next time.

Here in Alamosa, CO, they just passed a "noise" law directed towards modified exhausts, loud music and barking dogs. The City Manager for Alamosa lives 3 houses away from me and has a hound dog that barks all day long.......so far, no impact on him at least......
