Default More Shock talk

In March I bought our 2011 Durango Crew with 5.7l. Unfortunately factory warranty timed out so I bought an extended that does not cover shocks. Needless to say I was noticing some poor handling characteristics over bumps but no real noise. Looking under showed rear shocks covered in oil and grime(guess I missed that while looking at the truck). I see quite a few posts of shocks failing early and being backordered with no idea of an ETA and confirmed this at a local dealer.
If this is a big problem on these is there going to be any kind of recourse for an owner or do I have to shell out the money for new shocks on a 48,000 mile truck. The thing is starting to get scary to drive, never know which lane you'll end up in when hitting bumps(exaggeration)
Second question is how do I know which rear suspension I have? I may want to go aftermarket.

Rear; Except Electronic, Self Leveling and Performance Suspension

Rear; w/o Nivomat Rear Suspension

Try entering your VIN at the following link below "Equipment Listing" and check the Optional Equipment section of the resulting PDF.

My 2011 has the Nivomat rear suspension and it's listed as "Rear Load Leveling Suspension."

Well, you need to figure that out first.
