Smoked LED Tailights?
I just received my new tail lights today, and I'm going to put them in tomorrow. However, my dad thinks that if I were ever rear ended, it would be my fault for having smoked tail lights. They are led so it should be even brighter than stock. In delaware all u gotta do is be able to see them 500 feet away, so I'm pretty sure at about 1 foot away they are bright and clear. But what would happen If I ever were rear ended, my fault or theirs?

Here in Ontario (Canada) you'll have black cars with literally BLACK tail lights. You won't get pulled over but yes someone can claim they didn't see your brake lights. I've driven behind a few and its extremely hard to see them in the day time.
Mind you if you got rear ended you can claim negligence.
My tails are coated VERY lightly with Niteshade just to get rid of the red.
IMO, if you purchase smoked tailights then you should be fine. If you tint them yourself you could be asking for trouble if they are too dark.
