Default Idle controls and computer module reflash

Hello group, I just got back from my auto repair serviceman and he had to take my 2003 Dakota SXT 6 cyl auto trans (26k miles) to the dealer and have the computer reflashed to get control of a runaway throttle. He handed me a copy of a TSB from 2003 (18-034-03) in regard to a selective erasing and reprogramming of the PCM. I was told that this should solve my issue, I'll keep hoping that's true.
The problem was the truck would intermittently hold a high rpm (3000+) and surge into the brake at a light, I thought I was on a drag strip. There was no throttle down when I removed my foot from the pedal as if I was on cruise control (which is not installed on the truck).
The question is; Can I pursue a refund for the cost of this repair since I was never notified of this recall, I purchased the truck in June of '03? Is the PCM considered part of the drive train? And if so, has anyone else had this issue?
Thanks,
Bill

correct me if i am wrong, but i beleive you can bring your receipt down to your local dodge dealer and they will tell you how to move forward with your claim. if you had a recalled part replaced, dodge will send you a check.

I have had the PCM reflashed at the dealership and the problem persists worse than before.. Returned to the mechanic and left the truck to be repaired AGAIN. I will pursue a refund after the truck has been repaired, though now the powers that be are claiming a vacuum leak may be the problem, jeez I've only got 26k on the truck and this is starting?
It's been years since I did any work on my own vehicles due to the increasingly complex tools and knowledge required to fix even the smallest problem. I am at the mercy of computers once again.
Is this a common problem and would the PCM be considered part of the drive train?

I believe the PCM is covered under the Emission Controls Section of your warranty.

Turns out I went back to the dealership and they were able to diagnose the A/C pressure sensor as the problem. The idle flairing occurred when the defroster was active, since the sensor/tranducer was faulty it caused the idle to flair. I'll be having the repair made soon as the part arrives, meantime the transducer has been disconnected. Sadly, this is not a warranty covered item. The Datatech service my mechanic subscribes to called for the PCM reflash, as it happens it was not necessary and I'll have to absorb that extra cost.
Thanks for your responses.
