Water splashing up on the filter is not gonna hurt anything, you could probally spray the filter with a hose while the car is running and not have a problem unless you were reving the motor to high RPMs. You need to submerge the filter to suck water, unless you are racing in the rain, there is no problem what so ever.

Remember when you first put your intake on, that giant box you took out with it, the one that was in the fender, just so you know that BOX how a snorkle on it, on that hangs down about as far as your filter does now, NO PROBLEM there was there?
And to get to a point where you would actually need a bypass you would have to be deep enough in water to submerge your axel's now I don't know about you, but I don't plan on driving through a creek or river, unless I lose control of my car and put it in the river, but that's something different entirely now isn't it.
I guess what I'm trying to say is, Just leave the bypass off, you don't need it. I have driven through some seriously deep puddles with my AEM CAI on and had no problems what-so-ever.
