Here is the letter that my wife drafted up.

To Whom It May Concern:
We are writing to you to express our dissatisfaction with Chrysler’s review of the above referenced case number and their attempt to “assist” us with the issues we’ve had with our 2013 Dodge Durango.
We purchased this vehicle at the end of May 2013 and have brought the vehicle in a total of 11 times to date due to service related issues. Below is a breakdown of the service dates for the vehicle as well as the reasons:
• 8/30/13: Cylinder misfire. Service technician reprogrammed ECU
• 9/4/13: Cylinder misfire. Service technician replaced the fuel injector
• 9/9/13: Cylinder misfire.
• 10/5/13: Car overheated resulting in us having to pull off the highway with our entire family in the car. Service technician replaced defective radiator cap.
• 11/25/13: Temperature gauge fluctuating and difficulty in heating the car internally. Service technician replaced bad thermostat.
• 12/5/13: Cylinder misfire. No resolution. Service technician drove around with flight recorder over the weekend and could not duplicate the issue.
• 12/10/13: Cylinder misfire. Service technician replaced coil packs.
• 12/11/13: Cylinder misfire.
• 12/20/13: Cylinder misfire. No resolution. Service technician installed flight data recorder invehicle.
• 12/27/13: Leaking heater hose which caused low coolant and resulted in the inability to heat the vehicle
• 12/28/13: Cylinder misfire. Service technician is currently trying to diagnose the issue.
As you can see, 8 of the issues have pertained to a cylinder misfire and is currently still being evaluated by technicians for this reason. We have reached out to Chrysler/Dodge to in trying to rectify this issue as we feel we have been sold a
defective vehicle/lemon. We do not feel safe taking any kind of lengthy road trip with our 2 little girls for a fear that we will be stranded somewhere. So far, the only “assistance” we’ve been offered is the Trade Assist program, which does not appear to offer much assistance at all. While the “Trade Assist” would assist in paying off the current loan, it does not offer us the trade-in value of the car (which is more than
the payoff amount) nor would it reimburse us money we’ve already put into the car (total of $8,600 to date):
• $2,000.00 in down payment
• $3,000.00 in trade-in equity
• $3,600.00 in payments to date with another payment due on 1/8/2014
We understand that depreciation would be warranted based on mileage however we do not feel that we should have to incur any other deductions as a result of being sold a defective vehicle. We did look into the Trade Assist Program with xxxxx xxxxx Dodge on 12/19/13, however, their main concern appeared to be making money on the sale of a new vehicle rather than rectifying the defective vehicle issue. The quote we were given would have increased our monthly payments over $120/month, for a longer term, for a comparable vehicle. In sum, we believe we have been offered no assistance at all.
XXXX XXXXX Dodge has turned this calamity in to another opportunity to turn a profit.
We do not feel we should be penalized for having been sold a defective vehicle and based on the Arizona Lemon Law 44-1263 our vehicle qualifies as a lemon. The service center has addressed the same issue (or nonconformity) with the vehicle in excess of four times (44-1264(A)(1). We’ve asked that Chrysler/Dodge review our case as such, however, we have been advised that all they can offer at this time is the Trade Assist. As I’m sure you are already aware, Arizona Lemon Law 44-1263 requires the manufacturer to either replace the car with a new vehicle or accept the car back and refund the full purchase price, including all collateral charges, less a reasonable allowance for mileage.
We believe we have been more than patient with Chrysler/Dodge with the amount of times we’ve brought the vehicle in for service, the lost time in trying to get rental vehicles, and the lost time in negotiating the so called Trade Assist deal. While we know your technicians are still trying to diagnose the issue, we have not only lost faith in their ability to permanently correct the issue, but have also lost confidence in the car itself. If you are unable to agree to qualify this car as a lemon, and agree to either replace the vehicle or reimburse our expenses by 1/7/14, we will be filing a complaint with the Better Business Bureau and getting our attorney involved in this matter. Your attention is greatly appreciated.

to further update everyone, our apt yesterday was at 4:30 and prior to our dealer apt my representative from Chrysler had filled us in on how much we should be paying once we arrived. Chrysler based off of our case and the time we have had to deal with this, decided to drop the mileage deduction. The only thing we were responsible for was the MSRP difference + tax. So the 2014 was about 1k more than ours. With tax it amounted to around 1100 bucks. (Much better than almost 4k we would have had to pay). So we got there, started signing paperwork and then the number they have was about 1200 bucks more than we were quoted. So I stopped the process right there and mentioned the amount we were told (Which I know she also called to tell them the same thing). 5 minutes later the paperwork came back corrected. From that point everything went really smooth. Our bank approved a substitution of collateral, so in other words our existing car loan is now the loan on our new car.

In the end, Chrysler did step up to the plate and did what we felt was the right thing t o do.

All I can say is I don't wish this process on anyone! I will say though, the 14 is hella sweet I am really happy!!

Yeah cmon it wasnt yours at that time...
Your done with the disaster.
I think that dealership needs to restaff themselves as well. Their mechanics are incompetent and their staff is very sly and sneaky.
Wish you the best of luck with your new D, you are a patient family(I could not have controlled my rage on this).

Congrats man. Where did you send that letter? Chrysler HQ or somewhere else?

Also, a word of friendly advice. Find a new dealer and report that one to Chrysler. They may not have been able to screw you (although it sounds like they tried several times), but they will screw others who are less informed. A dealer like that should not be in business. Sorry to sound harsh, but I've just about had it with some of the dealers I've dealt with over the years. And it's not just Chrysler, but GM and Ford as well. You shouldn't have to go to 5 different dealerships before you find one that actually deals honestly with you.

Glad this worked out for you, bummer you had to walk through the desert to get to the oasis though.
