When is the last time you had your transmission filters changed and fluid flushed? They should both be done every 60kmi, but the filters definately every 100kmi an sooner if you do city driving.

So any ideas of what's up with this trans. The dealer can't diagnose it without trouble code

Well theree are 2 filters inside the transmission pan. It would be a good idea to change those out even if it doesn't fix your problem. That is where I would start!
Almost sounds like the filters are semi-clogged and not allowing enough fluid to build the pressurequick enough. using the electronic controls overrides certain gears and can help in shifting in the O/D gears.
