Oh, as was pointed out before, make sure you come away from this scott free... The other driver (since he was driving from the wrong seat) was at fault.. You should even have a deductible... Might even be able to play up some 'suffering' (IE, seeing your almost new rig wrecked!) for some more $ for a down payment!

Also, not sure of the laws where you are, but alot of states it is LAW that headlights must be on in inclement weather or when windshield wipers are operating.
The catch with all this is DID THE COP PUT ALL THIS ON THE REPORT. I hope he did, as it will now be your word against his. If nothing, a good lawyer can find proof that he is a rural mail carrier and can prove with reasonable doubt that he was driving on the wrong side of the car.

Here in IA the rural mail carriers all drive from the pass. side even if the car isn't set up that way. It is legal for them to do that (don't ask me how). Government overrules most things like that. Hope it works out for you.

I T-boned a 96 impala at an uncontrolled intersection. He had his lights off on a crappy rainy day, but he was coming from my right so technically he had the right of way. It'll probably go 50/50 for liability. Hitting him spun the truck around and down a ditch where that back door met up with a telephone pole. I had 3 passengers with me, no one was hurt. The driver of the other car was driving from the passenger side (no the steering wheel/pedals aren't on that side of the car) which saved his life. He came out with 3 cuts but nothing else. So yea, everyone is fine.
