Default My Dilema

Ok so I have $500.00 down off my credit card, and a signed bill of sale on an 09 dodge ram 1500 fully loaded laramie with ram box and everything.
Before I signed, the salesman and general manager made it very clear, that either side could opt out pending the May incentives if they weren't what we expected.

So right on my bill of sale, in the remarks section, they have written down...

"Subject to May 4th program change + Rules."
"Certified cheque or Bank Draft"

Now I am telling them I am backing out of the sale because lets just say the may incentives weren't what I expected. Now they are tryin to play hardball saying Im gonna have to go to court to try to get my $500.00 back because we have a legal binding contract....

Am I legally entitled to my $500.00 deposit back no questions asked and this bill of sale cancelled?

Yes Yes and Yes. They can't hold you to that and let them try and charge your credit card. Go ahead and walk. Your credit card company would never let that fly.

First thing in the morning call the credit card company and tell them the charge was bogus - you never received what you ordered. Tell them to reverse the charge off of your credit card.

Next call the Better Business Bureau and file a complaint. They'll send you a form that you will need to fill out and sign.

Next tell everyone you know or have ever known to never ever ever do business with this car dealer. Kind of reverse word of mouth!

Also, file a complaint with your state attorney general's office. Car dealers don't like to hear from the STATE. I had a situation where I filed a complaint against a dealer and I received a considerable amount of money back and an apology from them. They also had to refund money back to a number of other customers. They took a big hit and they deserved it.

Like said before all they are trying is scare tactics. They could care less about your little down payment of $500. They really want you to get scared of losing your money and go ahead and buy the truck so they can make their thousands of dollars off the sale. The sad problem is usually they succeed into bullying people into the sale/ car they cannot afford.

You could also call the local news. Many of them do stories when customers are getting the shaft and it results in the seller, or dealer in this case, to make things right to save face on TV.

I had the dealer order a truck for me, and it didn't come in soon enough for me so I made them give me back my $1000.00 check. Manager wasnt happy and he was less happy what I told him that I would tell everyone I know not to deal with his dealership.

Kinitex, Take a SLT for a test drive and drive right through the show room window and stop at the sales managers desk!!!!!!!!!
