Default engine light

I have a 2001 dodge ram with 24650 mi and the 5.9. The engine light will turn on when the gas tank is around half to three quarters full. If I fill it up and disconnect the battery the engine light will reset and will not turn on again untill the gas tank reachers the above level. It is most likley a sensor but my dodge dealer will not look at it unless I pay a $90 so called (refundable) fee for them to even look at it. They say if it is covered under warrenty then the $90 will be refunded. Has anyone else had this problem and if so was it covered under warrenty? thanks in advance

thanks for the imput. I have checked the gas cap a number of times but still have the problem. Im not totally cheap but is the gas cap covered under warrenty. I mean come on, I live in a emmisions state and I have vehicles that are 20 years old and have no problems with vaper leaks through the gas cap? Just my opinion. Could it be in the vaper recovery system?
