He just wanted to give you a rub down! Haha! But I have been pulled over for apparently swerving over the middle line to much. I told her sorry I was going around all of the pot holes in the road, she asked me to take my sunglasses off so I did...Next thing I know she has be against the rig and is patting me all over asking me if I have any weapons blah blah. I didn't know you had to really pat that hard but ok...She let me go saying not to go over the middle lines again.
She should have at least bought me a drink first...geeze

I agree, no rubdown until after being arrested. Americans everywhere need to simply make the PO pos follow the law of our land.

I don't mind the pat down, it is for the officers safety and I understand that, I know my rights, and I know they have to have probable cause, telling them no to a pat down or something like that, on federal property with 2 federal officers behind you, well that just means they are going to make your life hell.

I had nothing to hide, so I didn't mind, let them make themselves look like asses. I told them straight up I had 2 cases of beer in the back, and that I had a few beers the night before. I was out having a good time, I didn't want to bother myself with trying to fight 2 Park Rangers, I just wanted to do my thing, 15 minutes of him checking out my ID and giving me a field sobriety test, and I was back to doing what I wanted to do.

Would rather him check me for something simply like that, then not care, means he is protecting the island.

Now if it were something bigger, I might have actually said something, but for this little thing, it was a funny experience to me, and I was ok with it, and it made the weekend memorable (first Breathalyzer)

All in all, I understand not giving up your rights and knowing you rights, but c'mon, this was something simple I knew I could get through, would rather only spend 15 minutes taking a field sobriety test, then getting in the back of the ram, riding for 2 hours to the jail, and being forced to take the test there, if you refuse to take a field sobriety test, they do have the right to arrest you and take you to the station and make you take one there.

State Penalties for Breathalyzer Refusal

Alaska, Minnesota and Nebraska DUI laws provide for jail time for first offense refusals. With California and Vermont DUI laws, drivers who refuse the chemical test can be sentenced to jail terms if they've previously been convicted of DUI. In Vermont, the sentence can be as long as two years.

Under certain circumstances, fines for refusals reach as high as $10,000, not including court costs and increased insurance rates. In New Jersey, there's a $3,000 insurance surcharge for a first offense refusal, and that number increases with subsequent offenses.

Both New Jersey and Rhode Island DUI laws require participation in an alcohol treatment program for blood or breathalyzer test refusal.

NORTH CAROLINA: (where I was) There is an automatic revocation of driving privileges for a period of one year for a refusal to submit to the Breathalyzer when stopped for suspicion of a DWI.
Now which sounds better, 15 minutes of them patting me down and giving me a test while I'm vacationing, or one of those, you need to know your rights, but you also need to know when the best time to exercise them are, not every time, sometimes it can bite you in the azz

Indeed. The Jail I worked at here in Nebraska, we had state troopers bringing in guys all the time because they refused a FST. So In turn they get to lose their license for 30 days until they have court, come to the jail and get booked in, printed photographed, and then pay their little fine, and as long as they blow .000 they get released.

Just let them do their thing and be done with it. All of that sh*t above could easily take eight or more hours to complete depending on the day they come in. Tuesdays and Thursdays were court days and we always had an *** ton of court commits those days and we would have people sitting around for entire shifts waiting at times.

Exactly and since it would have been federal since I was on federal land and would have been arrested by federal authorities, I would have been sitting in there until Tuesday atleast. So, since I knew I had done nothing wrong, I said whatever and just laughed.

After telling the officers about the beer in the back I can understand the FST.

The pat down though I believe was uncalled for.
What reason did they have for that?
If everything has been told they had none.
Once you blew the 000 it should have been drive carefully and have a nice day.

Plus all of those states that have passed those laws about throwing you in jail for 30 days for refusing a FST is a clear violation of our Constitutional rights!
Your's and mine.
Now if you smell of alcohol then you are on the hook but if you cross the line because you're tired they are just using it as an excuse.

By all accounts though you should always remember to be courteous.
Above all of this; those officers have a very difficult job at times and most if not all should be respected.

Dont want to beat a dead horse, but...

Was Turbo driving? Was he driving in a way which gave Officer's a reason to pull him over? If you are not driving, a breathalizer test has no reason at all unless you are drunk in public and cause problems. An Officer can not assume anything but has to go by facts. Other than that it is harrassment as it seems they are trying to find something. If you get pulled over it should be for a reason...dangerous driving, suspicious activities etc. (and this needs to be proven by the officer as well)

Sure you get to go to jail if you were pulled over for suspicious driving and then refuse the breathalizer test if you are under the influence. BUT that has to be during a DUI stop...not just because ***** Wonka wants to.

Again, gonna leave the dead horse in peace now.
Just KNOW the law and your rights. The more we as society become complacant and inactive and have no more opinions the less America will be the America it is supposed to be.
In my job I can search anybody, their car and home at any time I please to do so...not even needing a search warrant. All I need is a suspicion...and that usually comes from the person I am dealing with not just because I want to be suspicious by nature.

Authority should not overstep rights. If you read the laws, read them correctly and find your place within them. You do not want to break 'em but you also do not want to give up your rights all the while respecting and knowing your responsibilities.

Sooo...anyways...did you catch anything with those big poles?

Alot of cops do that to try to catch you in a lie or something. @ years ago i got pulled over cause the cop thought i didnt have my seatbelt on. Before he told me why he pulled me over he tried for 10 min to catch me in a lie. He asked about 8-10 questions about what i was doing and where i was going the he would start at the top and ask them again but word them a little differently looking to trick me. I had nothing to hide and did nothing wrong so no matter how he asked the answer was the same. Pissed him off so he let me go once he realized he didnt have anything on me.
