Default bent Swaybar?

Ok i was under my car taking measurements from the manifold to the end of the Cat. and i looked over and saw this.

so obvious the bushsings are bad but the other side isn't like that at all (bent that way) with the tires off the ground. but when i jack up that tire to where it would be for driving it became flat like so.

does that mean that the sway bar is bad? or just the bushings are bad which are causing it to do that.

Noticeable amount of rust where there's contact probably means that the bushings have been compromised, I believe they're supposed to make a seal. I could be wrong though. The amount of cracking on the rubber pieces would concern me as well.
