Default First gear slips

Problem with a 2002 Dakota automatic transmission that will work fine after it has set for awhile (10 to 30 minutes) The first time you take off it shifts fine but after it shifts out of first gear the first time it will take off in second gear every time until it has set for awhile again. It does not have a check engine light on and no code return when scanned.

What engine do you have so we'll know what transmission?

It has a 3.9L 175hp engine with a automatic transmission. Today i could let it sit sometimes for just 5 minutes and first gear would be there but the first time i stopped it would always take off in second gear.

OK, it's the 42RE. This is from the factory manual.

NO LOW GEAR (MOVES IN 2ND OR 3RD GEAR ONLY)
1. Governor Circuit Electrical Fault. Test with DRB® scan tool and repair as required.
2. Valve Body Malfunction. Remove, clean and inspect. Look for sticking 1-2 shift valve, 2-3 shift valve, governor plug or broken springs.
3. Front Servo Piston Cocked in bore. Inspect servo and repair as required.
4. Front Band Linkage Malfunction. Inspect linkage and look for bind in linkage.

Low gear works perfect after it sits and as long as it does not shift up i can go around the block but as soon as it upshifts into 2nd gear from then on it will slip when i take off until i let it sit for at least 5 or more minutes. Ammaco did a free scan and said it returned error codes but did not give me the codes. Then a week later i took it to a different place and they scanned it and drove it and said they could not get it to give any codes and that was a 160 mile round trip for that test. I have two more places i want to take it to and see if they can pull any codes from it.
