Got a ticket today, should I fight it?
I just had a buddy who got stopped at routine traffic check point they had setup on a saturday night a few weeks ago, one of those ones looking for drunk drivers. Well the guy has some serious sinus (allergy) problems so his eyes were very bloodshot and the cop saw this and had him do a blow test - which came up negative (the guy is actually a VERY devout southern baptist and doesn't touch alcohol). So naturally the cop suspected drugs and while one cop stood with him, another did a search of the car and found four pills in an unmarked bottle, with the name on each pill. Against the law in Georgia. They were prescription allergy pills prescribed to the guys mom and she gave him some to see if they would help with his allergy problems.
So now the cops write him a traffic ticket for having the pills in the car with no script for them in his name and let him go on his way.
He calls the court a few days later and is told the fine, if he pleads guilty, is $1170!!! At which point he called a mutual friend of ours who is the court clerk in the county where my farm property is. Court clerk advises him to let the judge open the case and as soon as the officer is asked to take testimony, he should cut in and ask the judge to dismiss the case, on the grounds the court has no jurisdiction to hear the case citing as per Georgia law, possession of narcotics (prescription or not) is NOT a traffic violation and therefor cannot be dispensed on a traffic ticket form. Instead, he should have been arrested at the scene and charged with a crime.
The judge had no choice but to comply and dismissed the case and because testimony was taken on the case, the case could NOT be retried in the proper court under the proper charge.
Just shows you how LITTLE the cops who are charged with enforcing the laws, know the laws!!!
