Some states cant do that. in CT we have to go through emissions and thats a big no no. but i do agree with you. If you wanted to have a pipe there (helps with flow), gut the cat and slide a pipe through it. that way the exhaust connects to that pipe and you dont lose any flow from the large chamber. Its a thought, havn't done it myself. I would just gut it and stick it back up. my father did, and i like the way his sounds.
Its mostly not to do with the states. Its mostly the Feds. Some states add on additional or more stringent emissions laws (CA for example), but most other states no one cares except the Federal Government. I believe it used to be a $10,000 Federal fine for any shop to take off a catalytic converter (if they are caught), not sure what it is now, but I think they may have raised it even higher. Plus there are personal fines as well if you are caught without it.

I just had a high flow cat put on mine. While I was waiting for them to get done welding, a kid came in asking if the shop (Meineke) could remove his cat for him on an 1982 Dodge pickup. Even though I live in SD, where there are no state emissions laws/tests, the owner of the shop came out and told him flat out "No, we cannot touch the converter unless we are replacing it."

The sucky thing is, even if it passes emissions tests, it still is illegal to not have a catalytic converter.
