Default P040D code

I really hope to find the answer to this. 2011 ram 6.7 bought the truck and it already had been deleted and has a tune(I have no idea what tune unfortunately). The issue that I'm having is the code P040D. I have tried to clear it and the only way is to disconnect the batteries but then the code will pop back up after a day or so. I can definitely feel and hear when the problem comes back before I even see the code after scanned. The truck feels sluggish almost like the E/B is engaged - takes more gas pedal to get her going - shift harder at times - when trying to accelerate it just kind of bogs instead of down shifting - if I stand at the front of the truck you can hear a rattling or kind of a knocking almost like a bad lifter sound more so on the passenger side. When I disconnect the batteries over night and start it, drive it. Everything is good no rattle, no code, no surging feeling while drive(happens while driving under light load - cruising). Drives like a dream.
I have read countless topics of others having this exact problem but haven't seen the one that has found the Holy Grail to the P040D code. I know there are diesel gods out there that this is a walk in the park for them. Please help......

If egr has been deleted, then your tune didn't account for that. The code is whining about the EGR temp sensor...... and since it (likely) isn't there....... That's gunna be a problem.
