So do the 2008's have the complete EPS shut off?? They advertise that for the 2009s but given the struggle on burn out, makes me wonder?

nothing has complete shut off of ESP...even if you push the button to turn it off, it's still kinda "on" and automatically reingages over 30 or 35 MPH...only the police cars have complete shut off of the ESP

Really? I believe you, but the Chrysler LLC should be more careful in their press releases where they highlight that it is a complete shut off, no longer has "rescue mode".
