that number has to do with the sim key programing. there's actually a way to erase it, but not too many people do it, mainly because it's a pain and the dealer has to do it anyway.
I guess not too many "tree huggers" are going to be buying the Stage 1 or 2. I'm still surprised my dealer offered to install mine, since they also do state inspections.
s1 and s2 will pass emissions, even in cali where the smog ****'s are out in force. mopar just didn't bother with the expense of the testing.

s2 uses bigger injectors, and recommends a different exhaust. it also does not utilize the second o2 sensor that's in the car, which can be an issue. one problem that people are getting concerned about is that some states are moving to an odb test, in which they hook the car up, and if any code is thrown the car fails. s1 and s2 both throw a code.
really, there's no reason that it wouldn't pass, and it does with no issue. the thing is that it's not emissions legal, nor are the stages CARB legal. thus they have the warning for the not legal on emissions controlled vehicles. it would have been expensive for mopar to get the paperwork, so they just didn't do it.

They'll flunk you for a code that has to do with the sim key programming?
In different states, what constitutes a fail is different. In some states, ANY code is a fail. In others, just emmisions related codes. Depends on what the repair/inspection shop lobby could get away with/buy
As psi chick said, the "Stage" code. P0633, SKIM key not programmed into PCM, can be erased for good. anyone wanting detials, just say so. If I hads to deal with emmisions, I would do so just be sure. And while the Stages don't use the readings from the 2nd O2 sensor, it DOES still look to make sure its there.

SKIM = Sentry Key Immobilizer Module (located in dash, just where the steering column goes through)
Sentry Key = self evident (contains microchip, interrogated by SKIM, read by antenna embedded in ignition switch
SKIM interrogates key, recieves code, performs algorithm, sends raw information to PCM, which then does it's own algorithm, PCM sends it's answers back to SKIM
SKIM compares it's answers to PCMs answers. Incorrect key code = P0633 code set. Incorrect VIN = shutdown after 3.5 seconds.
Luckily for us, the key data and VIN can be rewritten using a DRBIII
