Soapy are you sure?Its hard to tell the size its only 1" diff. How many bolts on it? I have a 2006 TRX4 AWD with tow package (3.92 gears) and the 4.7 and its an 8.25. Surprised they would increase the size...
If you go to the 'build' section on Dodge's website, it doesn't show ANY Dakota available with anything but the corporate 8.25" rear for '08. I seriously doubt your '08 has the 9.25" dude, sorry.

I'd check the sticker in the glovebox before concluding one way or another. Build and price sometimes is on crack.
Also, look at "specs and upgrades" on a Laramie... on those the 4.7L is standard now, and the website correctly indicates the 9.25" as the axle used.
Edit: another way to know is to check the diff cover shape... 8.25" are a little rounder, 9.25" have a definite octagonal shape.

I just took delivery of an '08 TRX4 with 4.7l V-8,full-time transfer case with AWD, tow package, 3.92 gears and just about every option you can get and it has the 8.25" axle. I was the one who originally posted the question about Dodge using 8.25" axles for full time 4WD and 9.25" axles for part time 4WD. Go to any Dodge dealer and pick up the brochure on the '08 Dodge Dakota and you'll see in the specs page, that 4.7l V-8 Dakotas with either 2WD or Part Time 4WD get the 9.25" axle and Full Time 4WD gets the 8.25" axle.
