yah... kinda sucks ... but in Canada you either hang way back when the sander is around, or... grin and speed past. I've chipped a lot of windsheilds over the years.... not too bad on the paint though...

That is not a bad idea, spend the money and get a letter from a lawyer with your intentions if they don't choose to fix it now. Then you wait and see what they do, worse thing is you won't get it done?
