They told me there is nothing they can do for me as far as diminished value is considered. They did however value my truck at $2,525 however the sleazy appraiser wrote for $2,270 worth of unrelated damage! So they offered me an ACV of $500 + tax (6.25%) 31.25 = Net $531.25. I told her I wana see the appraisal report, went over it last night and found tons of errors! Check this out I got lines number 3, 6, 8, 11, 14, & 18 removed along with various others in between, they were guna try to pass this off! After all this it is still a total loss but they are going to give me $1,953.97 to fix the dent and my title stays the same!

You know what I hate even worst is a young SOB hits me head on. You know the type. Young, rude noob that thinks his crap is better than anyone else.

But then again, what does age have to do with it?

Is that how it works here now? I wasn't 100% on that but it makes sense. MPI is a bunch of crooks. If it's fixable, why write it off and mark it irreparable? I also heard that if your vehicle is 15 years old or older, and the safety is up but its insured, they can call your vehicle in to one of their approved shops for a safety inspection

pinkfloydeffect, that sux, and thats why I would rather, in that situation, just tell the guy to pay off, or let it go. I'd rather repair the damage myself then risk my insurance company writing off the vehicle and marking it irreparable. But rules are different everywhere you go too I guess

Sorry, what I meant was that if it is a write off, it is automatically irreparable. ie: my '93 was rear ended but was not a write off. If it were, it would not matter what the damage was, it would be irreparable and only good for parts. So Any first gen Dakota that I buy is most likely going to be just for parts

You should be able to talk the insurance company into a settlement that allows you to keep the truck AND collect some money - though it won't be quite as much as the 'full' settlement. So long as you don't sign it over to the insurance company, it will remain a normal title.

And the damage here is clearly only cosmetic, so no worries about it not passing safety inspection, if that's even a concern in your state.

As a general rule, I try to be wary of any initial offers an insurance company makes - especially from one of those 'mobile instant response' claims agents (like Progressive....). I haggled a bit with an insurance company once after my old Fairlane got bashed in the side. The insurance company, of course, wanted to total the car for $850. I argued with them a bit and got to keep the car, and still collected a check for $600. Not enough to buy ALL the repairs, obviously, but still better than nothing. And the title never changed hands.

You guys need to read post #21

The insurance company deemed it a total loss, they are going to buy it for $1,953.97 BUT I get to keep it for free AND my title does NOT change to salvage since it's older than 10 years old! To sum this up for you, absolutely nothing is happening here accept writing a check for the dent according to the agent, if this happens again the truck can even be re-totaled and bought out again! (I made sure to ask)

I don't know the laws on salvage titles, but I bought a 96 a few years ago from a wrecking yard, and when I went to have the title transferred at the MVD, the chick asked if I knew it was a salvage title, so I acted dumb and talked nice to her, so she gave me a regular title... I'm still not sure how that happened coz she was smoking hot and didn't need to buy a date with a title upgrade.
