My 08 Aspen started doing it around 38k miles. Gotta love the fact that Chrysler knew the tanks were/are defective, and continued using them for years, even after the recall.

gas tank overfill; dealer replaced tank, then the new tank would not accept gas w/out shutting down the nozzle. Subsequently, dealer replaced the filler neck tube. Same problem. The dealer is stumped, says he will call Chrysler.....

Default Dodge Durango Fuel Overflow Problems

In 2011 so far there have been 72 documented complaints to the National Higway Transportation Highway Administration for this issue on the Dodge Durango. Model Year 2005 (25), Model Year 2006 (32), Model year 2007 (9) and Model Year 2008 (6).

Chrysler Aspens have the same issue but not in the numbers of the Durango Owners.

Visit Automotive Recall For Consumers www.arfc.org for information.

Go to the NHTSA website http://www.nhtsa.gov/Contact and send a complaint and ask (BEG) them to open an active investigation.

Go to https://www.chryslergroupllc.com/contact_us and send them an email and ask them how they can continue to ignore this issue.

Keep sending emails to the NHTSA and to Chrysler to take action now

Chrysler says they can not do anything because it is an out of warranty repair and no recall.
NHTSA says that there is no active investigation and provides not much additional support.

Last week I read a news article that the NHTSA issued an investigatin for Toyota with only 32 complaints agains the vehicle.

There have been 72 just this year and what I can gather nearly 400 last year for this problem.

There has already been a recall for this problem but the rest of us who have spend money for the Durango and Aspens are being treated like we are stupid.

DO NOT LET THEM DO THIS!

Contact your state attorney general and complain.

If we all band together, maybe they will get the message.

I bet if we took the Durangos to Detroit and asked to see an executive and took him to the gas station to fill the vehicle up, he would not see the same thing that the case manager keeps telling me each time they call or I call that this is not a safety issue.

they tell you that you will have to COPAY (350 for me) them the rest for about a 1200.00 repiar.

I complained and complained and they feel like they are doing me a favor and have lowred the price down to 100 dollars for the copay.

Never been about the money, it is about the fact that they have a huge problem and want to continue to give us the cold shoulder and ignore this problem.

Maybe they don't wand to ruin the roll out of the new Dodge Durango but that is just a thought.

Durango and Aspen owners it is time to unite and flood the phone lines and the email boxes of Chrysler and NHTSA for them to act.

Ask him to look at this thread. He'll see that this has been a recurring issue with replacements. There are some examples of multiple tries before they get a working tank/neck combination.

We were lucky. They replaced our tank at NO CHARGE, and the first replacement seems to be working OK so far...

You guys got any pointers on who to complain to?

I'm looking at a $322 (in addition to $89 already paid for the diagnosis) bill for filler neck replacement on my 2005 Durango with the "wrong" VIN (not a recalled one).

I've been working with Chrysler right from the start, dealing with a case manager. They are going to reimburse me $140 (why $140 and not $120 or $150, she couldn't explain). "That's our final offer," is the quote. No amount of verbal judo did any good.

I've got all the events and conversations documented and filed them in the narrative section of my complaint to NHSTA, including the admission by both Chrysler and local Dodge shop that the problem is indeed identical to the one described in the recall of the same model and the same year.

Back to my initial question: I've ran out of options as far as to whom I can appeal.

I spoke with Shari at 800-853-1403. She got us a free replacement of the filler neck and gas tank after polite persistence AND a mention of the legal liability they had for both health and environmental damages.

From what our Dodge dealer said, the filler neck alone will not "fix" the problem. You have to get both replaced.

As noted above, polite persistence along with copious documentation here that several folks have gotten a new filler neck AND tank installed for $250 or less should be some good ammo.

I think I would be asking why they are not willing to at least treat you as they have others in this regard.

While some folks seem to want to live with this issue, gasoline is nothing to screw around with.

I'm not a lawyer by any sense, I would think that selling a vehicle in this condition to someone after the owner is aware of it, could come back and bite quite hard in the sue happy world we live in today.

Appreciate your answers.

I've called 800-853-1403, they pulled up my case and asked me if I sent in my receipts (that comes from their notes since it was the last thing they told me to do, get it fixed and send in the receipts.) I asked them how come other Chrysler customers with the same issue get the full refund, and I'm getting only $140.

First reply was "Those must be the customers with the vehicles being recalled." To which I gave a negative reply and asked why I am being treated differently from other Chrysler customers.

The CS guy said when I send it my receipts I can express my concerns in a letter and support my request for full then refund. If I'm still not satisfied, I can apparently appeal.

Basically, they are not going to promise anything at this point and I can't do anything until I file my receipts and wait for their refund.

Default Dodge Durango Fuel Overflow Safety Issue

With 44,951 Durango's recalled from Model Year 2005, 447 complaints to the NHTSA last year (2010) and so far in first 76 days of 2011 there have already been 95 complaints just on the Dodge Durango.
The case manager at Chrysler has closed my case because I did not accept the gratuity of assistance with the repairs. The repair started out at 350 dollars plus the diagnosis fee, and after telling them to pack sand and that I was going to pursue this by exposing some bad publicity to the company, they called back and said just 100 dollars.
I told them that they were missing the point that this is not about my vehicle, but all of us who are out there driving the Durango around and having to deal with a HUGE safety issue.
I contacted the investigative reporting departments of ABC, NBC and CBS yesterday and provided them the statistical information and the frustration that we are all having and asked them to take a look and see if they would be interested in reporting on this issue.
Continue to call the NHTSA at 1-888-327-4236 or email them at http://www.nhtsa.gov/Contact and ask them what they are waiting for to open an investigation and direct the recall to start.
Continue to call Chrysler at 1-800-247-9753 or email them at https://www.chryslergroupllc.com/contact_us/form and ask them why the will not initiate a voluntary recall.

Since the check valve in the tank system is failing to close during fill up preventing the backflow of gas, I also wonder if the vehicle was to be involved in a collision and rolled over, would the contents of the tank be allowed to drain down the fill tube, out the gas cap and then onto the ground creating a hazard for rescue.

Update on my 06 Durango. First started with gas spill out on fill up. The dealer put in a new gas tank. That created the opposite problem....would not accept gas properly w/out shutting off the gas pump. He then replaced the gas filler tube....same problem. Returned today, and he showed me something very interesting. He showed me a Chrysler service bulletin that pertained to every Chrysler product...Dodge, Chrysler, Jeep, and with most models included within each brand. All have gas tank issues, depending on the specific model and year. However, the specific TSB was for the tank refusing to accept gas. In any event, the dealer is replacing my evaporator canister and related parts as he believes that is the reason for my 06 not accepting gas properly. We also chatted about the gas tank issues in general, and he believed that the design is more at fault than the parts. I'll update after the aforestated is repaired.
