Up to you man, but like Ron said, if its itemized on the receipt as extra, go after him. $250 is quite a bit of money compared to a couple hours worth of phone calls.

If someone had stolen $250 from me, past headaches or not, I'd be after them like a dog after a squirrel.

It was definetly something I paid for in addition to the original transmission. I remember him asking me over the phone if I wanted to add a deep dish pan and heavy duty cooler to the unit. Had I declined his offer, he would have put on a stock pan. So I know for sure I paid for that pan seperately, and it had nothing to do with with whether the unit was performance or not. My dad thinks I should let it go, but then again, my dad isn't the one paying the loan. But, I feel a little cruel defying my dad's suggesstion considering he's the one who helped pay for the lawyer in the first place. I already defied my dad by calling N.E this morning. I personally am erked about it. My dad says I should just be more concerned about monitoring their unit, then worrying about the pan. I know, and my dad knows, that Mark is a smuck, and that he stole my deep dish pan.

I'd like to hear what you all make of this:

This morning I started up my truck and let it warm up about 15 minutes (was -5 below). I had the transmission in neutral as well. Then, I came back to get into the truck, and hopped onto the road. The truck usually shifts into third gear at around 41mph. My truck refused to shift into third gear. I didn't want it to be damaged, so I drove all the way home from work out of overdrive. Several times I pulled over thinking maybe the tranny fluid wasn't warmed up enough and I would sit on the side of the street in neutral, then I'd try to go through the gears again, and it wouldn't shift into third gear. I tried pulling over and putting it into park as well seeing if it just needed a rebooting, and that did not work either. I have to go to class right now so I would like to make some more tests throughout the day before I make any conclusions. As it stands now though, the truck would not shift into third gear, it just kept reaching higher and higher rpms when it should have been shifting at around 41-42mph.

Is the trans filled to the proper level with fluid? I had a truck once that wouldn't shift out of 3rd and it turns out that the fluid was low.

Took the truck out for a ride after class and it seemed to be shifting fine.

I wonder what would have caused the truck to not shift into third gear like that. It was incredibly cold, but the truck was running very warm on the way up and still wouldn't shift. But seems to be shifting on que again..

Well I'm not sure to be exact. I just know it shifts into 3rd gear or "lockup" at around 42mph. It was refusing to shift though, I'd get up to around 55mph and it still was not shifting, the rpms just kept getting higher. When I got home I shut her down, and went to class. After I got out of class, I started the truck back up to take it for a test drive and it seemed to be shifting fine like it usually does. Just confused as to why it was doing that. Could it have been the absurdly cold weather?

The PCM will lock out 4th gear when the fluid is below 50F.
