HELP! Dealer says to "pick out whatever I want" in response to my defective 2012 Crew
Hey all,
I have been cruising around here for some time now and about 3 weeks ago, purchased a Certified Used 2012 Durango Crew (21k miles). After about 3 days of ownership, my Durango would not start. Roadside Assistance tried to jump start it and got nada! It was towed to my dealership here in San Diego and repaired in a couple of days, only to occur again... It was towed to my dealership AGAIN and I received a call yesterday and my Service Advisor stated that it "appears" that the they had found the root of the problem (Master fuse blown due to faulty battery). In addition, she also let me know that the tech that was working on my car had backed up into a pole and the rear bumper sustained damage and they would have to order me a new bumper, which wouldn't be ready until Friday. Disappointing to say the least, however I understand that accidents happen.
I had already spoken with the Director of Sales and expressed my dissatisfation and told him that I am not able to travel with the peace of mind that one should have after purchasing a fairly new car. I let him know that my family and I had planned a couple road trips and that my confidence in my Durango was now non-existant due to the issues, after not even owning it for a month and less than 120 miles on her. being that I would be in debt for the next 5 years, I suggested that they assist in getting me out of my Durango and into a different one.
The Director of Sales called me this morning and said "come down and pick out anything you want and we will work it out!" That being said, would you think it's realistic that I choose a 2013 Crew with leather and nav, although my Durango did not have those features? Regardless, I plan on fighting tooth and nail for this 2013 but I just thought I might seek some advice from the community! The Director knows that these issues with my Durango have caused a huge inconvenience to me and my family, not to mention the time, gas and money spent (additional coverage on loaner car at $11 per day for 5 days).
The 2013 has the following features that my 2012 did not have:
Nav
Leather
Blind Spot Sensors
Heated Seats
Telescoping Steering Wheel
Chrome Door Handles
Sirius XM Travel Link
Speed Control (I'm guessing the Adaptive Cruise Control)

I like your choice's and you too will like those features. I'm not usually one for all the safety features, but having tried them out, can't imagine driving without them again. I say...go for it!
I have always been apprehensive about trusting ANY dealership, so be careful about this convenient move they are taking to make you happy. Ultimately, if they put a deal down in front of you that you think makes sense, then take it. Something tells me, though, that this won't be the case. I apologize, but life in the big city has led me to be a "glass is half empty" type of guy. I certainly hope, for your sake, that I am completely wrong!

I totally hear what you're saying! That is mainly the reason I want a brand new 2013 Durango Crew! I am set on refusing any increase in my monthly payments, any additional money required to get me what I want and most especially another pre-owned vehicle. If they can't meet my requests, then I will suggest that they rescind the sale and I will take my business elsewhere. I know that is the last thing they want to do....
If they can, in fact get me into a brand new Durango without an increase in my monthly payment or money out of pocket, then I'll be more than satisfied. Regardless, I will be sure to keep yall posted!

I certainly believe they will let you pick anything out and you guys will work it out.
I would interpret that as them applying your original purchase price towards the next vehicle, on which they will hopefully offer you a very good deal. They are not legally obligated to take back the first vehicle, that is the favor they are doing for you to keep you satisfied. You can't logically expect more than that, especially if they truly give you a great deal on the next vehicle.

As some mentioned, they are just giving you a trade assist. Which means they'll just give u a little more money for ur trade, and probably give u a good deal on the new car you pick. However, if your car worth 20k, and you want a 40k car, you will be paying out of ur pocket for the difference. They are NOT giving u a $40,000 car for $25,000.You also have to understand, the more fancy feature it has, the more likely hood things breaks, and expensive repair. It is the reality.
And as mentioned, they are not Legally obligated to buy back ur car just because you are **** off. They could just fix the car and tell you "you bought it, it is ur problem now." Lemon Law works varies from State to State if you decide to take the case to the court.
