Well, beings the fact that you are in Canada, I don't think the BBB is going to do you any good.
As for the damage, a lot of dealers have signs up that specifically says "Not responsible for anyloss, damage or theft while vehicle is on this property" or something like that so, you might just have to get your insurance company to repair it, let your insurance company deal with the dealership.
Unless he doesn't have anything posted about loss or damage, then he might be responsible for it, or if you can prove that they did the damage then they are responsible.
Again, that all depends on what the laws are like in Canada.

The BBB is not there as a voice or middle man in the services rendered disputes between a company and a customer. They are there to sign up as many companies as possbile and sell advertisement space as a for profit company. Anyone that thinks the BBB is a resolution tool against a company is crazy

Yeah, Ive had issues with downview chrysler... i actually dont deal with them with anything anymore by some bad experiences with them....
i go to Ontario Chrysler on dixie and 401 or used to be mills and hadwin on dufferin and lawrence....anyways back to your problem...
just call chrysler Canada and see what they have to say.....and bring it up to the dealer...talk to the owner of downsview...i believe its some Indian man....see what he says....

THe dealer is 100 % responable, thier taking your car to service it, they take possion, have thier employ'ess drive it than park it, and thier service people work on it, dealers have insurance for this, all BUS, have to.
Your on the dealership property, thier responability.
I'm going so start on a poll ( don't know if I can name names ) of good/bad chrysler dealerships...

I didnt say use the BBB as his ONLY recourse. It does help to report them, at least in my small town. So i stand by that. Notice how it says " Lawyer Up" before that, ohhh thats right.
I agree with parts service. As long as they were not driving it, they are not responsable. Your insurance is. It's no different than if your parked in the bay at the oilchange place, and i rearend you and drive off. The oil change place is not responsable.

way to go parts, backing the dealership.
Hope they file it as vandalism so it falls under comp which you usually have a lower ded and won't hurt your premiums.
Now to really make your socialistic Canadian *** burn, something called no coverage for bailee, basically if an employee steals the car or like if you dropped it off at a tire store and they stole it your insurance won't cover it all. Not familiar with canadian insurance, lic in 40+ states here. God its boring.

the problem with the BBB is that you are not going to be able to report a company that is not a member of it. Period, it will do you no good to waste your time with that route.
Here in the states you would get further dealing with the damage issue to your vehicle as long as it is in the fenced off or assigned area for repair where all the rest of the in-service vehicles are kept. It is their responsibility because their employees are usually the only ones allowed back there to begin with, the exception being tow vehicles and transport trucks... usually. But seeing that your in canada you are in a whole 'nother ballpark law wise. I would suggest getting a lawyer if you are unable to get a better timely response.
As suggested if you need the use of your vehicle then you will be forced to have your insurance cover it and then they will try to subrigate against the dealer and maybe with some greater success than you since they are bigger, but dont count too heavily on it for remember the insurance co. already has your money and it isnt that big of a deal to them to tag you with a higher rate to compensate for their/your loss.

Wow that sucks! As you can tell we are all **** about our trucks and who looks at them wrong. I hate to say it but unless it is proven that the truck was damaged in the shop, by their driver & you picked up the truck as soon as it was repaired you don't stand much chance.
I have found the BBB to work well to vent with and to back me up with a complaint but all a company has to do is NOT CARE ABOUT YOUR COMPLAINT.
I had my truck hit the first week on a construction job that I ran. My company had a contract with the client, the general contractor had a permit and the sub-contractors were all insured. This happened in a lot that was covered by cameras. But one large box truck hid who actually hit my truck.
Some one is responsible but no one was going to pay.
As soon as possible call the local police where the dealer is and file a vandalism report and state it was on the company's lot. Most insurance companies will reluctantly pay for it if it was not operator caused, (parked).

Just Got Back From The Dealer Myself. It Was The First Time Someone Worked on My Truck Other Than Me. By The Time I Left, They Were Thanking Me For The Input. They Claimed They Could Not Recalibrate My Spedo. With A Call To Parts/Service (A Moderator Here on DF) I Found Out I Could. Needless To Say, They Were Wrong - It Could Be Done.
I Heard The Technician Pull My Truck Around The Building (Loud Exhaust) It Just Snowed and The Parking Lot Was Not Plowed. I Heard Him Ham' Down The Throttle, He Came Around The Side of The Building Drifting Sideways - I Was PISSED. My Gut Was Churning The WHOLE Time He Was Working On My Truck.. It Was The Worse Feeling In The World.
I Don't Care If Its Still Under Warranty, I Wont Bring My Truck In The DealerEver Again. There Are Very Trustworthy Dealerships With Great Technicians Out There - Sounds Like Parts/service Runs One.. But I Have Yet To Find One Myself Here In Chicago.
