03 5.7 has no EGR. 04-08 1500's have EGR, 04-08 2500/3500 5.7's do not. That means your replacement engine came out of a ½ ton. There is no software code in your PCM for EGR use as well as no harness to connect to it. They should know this but it doesn't surprise me they don't.

I called the smog shop this morning and the tech insisted that the engine requires an EGR system based on the Motor " Emission control system application guide" - link above. That's the only criteria smog shops use apparently.

And yes, it's a Colorado truck registered in Wyoming. The tech never mentioned presence or absence of CARB certification.

And I did wonder about it never having thrown a code referencing the EGR system. I asked about the harness during the first visit and he said, "It must be tucked away somewhere."

I'm kind of stuck. None of the threads here have much helped in terms of documenting originally the truck did not have an EGR system.

I did make a phone appt. with the BAR who will see if I have a legitimate case, and then if so, actually look at the truck. I'll follow up a week from today in case anyone else is interested in this topic.

Or if the BAR appeal is shot down, get a used egr, tube and harness and fake it... They only look to see what's there - the truck passed all the tests...

These idiots.....I would go find an identical truck for sale, take it for a test drive, go over there, then ask them to find the #$^%& EGR that won't be there.....

For those interested in registering an out of state Gen 3 2500 in California. I had a virtual appt., and then was referred to the Bureau of Automotive Repair where a referee would look for evidence of tampering. The virtual appt. guy couldn't find evidence either way that an EGR system was installed on my truck (2006 Ram 2500 w/hemi). I had to drive an hour and a half to the BAR referee who also didn't find evidence of tampering with an actual inspection. He used mirrors and crawled underneath it and studied different books. He concluded that it didn't come with the EGR and I got an exemption on the truck and was able to transfer title and register it in california. It's a pain in the butt, but at least it's done...

Glad you were able to win this, hopefully you don't need to repeat this process.

The BAR referree put a sticker on the body that said the truck was exempt from EGR requirement. He said to make sure the next smog tech that tested the truck saw the sticker.
