Warranty Work Run around?

Default Warranty Work Run around?

I have a 2006 QC Hemi with a sunroof, that I have only had for a little over 3 months and 3500 miles. After the recent rains we had here in Houston I noticed a puddle of water on the passenger side floor board. Took it to a dealer and he said that was common and that there are some screws that come loose and needs silicon. Fine no prob took it home a few days later after another rain there was the puddle again. Took it back to the dealer and he said it was going to take a few days and gave me a loaner car. When I picked it up they had changed the sunroof glass and carpet. Took it home and got a water hose out and sprayed the truck down for a few minutes. Opened the door and there was the puddle again. At this point I'm steaming mad. Called dealer up and asked if this was a joke? No sir was his response and he told me not to bring it back to him, and to take is else where since his tech cant fix the problem. So I called a bigger dealer that said they could have the sunroof changed out in 2-3 hours and bring it in, in the morning. Got there the next morning and he told me that it was going to take around 6 hours and that I only get $35 for a rent a car, since they don't do loaners. And if it took 2 days I would have to pay for the rest. Now I mind you that the truck is only 3 months old and 3500 miles and this is the third time. So I kinda go off on him a little. Since when are we responsible for a rent a car for there faulty product that they could not fix with 2 attempts? Also has anyone else ever have this kinda run around?

Well first I would like to point out that we have had vehicles in numerous times to chase down a single problem.
And we would get just as frustrated as the customer would, but I would NEVER tell them to go somewhere else.... that was a horrible thing for them to do - if they sold you the car.


But anyway. There is no provision in DCX's warranty to promise you a loaner/rental car.
Service contracts will cover up to $35/day for overnight repairs.
So it sounds like dealer #2 is giving you straight answers.

To me it sounds like your selling dealer should be taking better care of you.
Go back to them and tell them you want THEM to fix it - they sold it, they should be able to fix it.

But the loaner car is strictly a courtesy, warranty WILL pay up to $35/day - but they are not OBLIGATED to.

Thanks Dodgedir for your response. First, I should have made it clear that the dealer I took it to the first time is not where I bought the truck. I tried them and told them what truck I want and where it was and they was unable to work things out to swap with the other dealer that had the truck. So I had to goto dealer #2 to buy the truck. So the dealer that has the truck now is where I bought it. Dealer #1 was a local dealer down the road from the house.

Second, I under stand that on some things it might take several tries to repair something (computer, engine, tranny). But a water leak, all you have to do is spray water on the truck and see if it leaks. Thats what I did when I got it home that same day.

So under the 3year 36K mile warranty Dodge does not offer a $35/day expense for a rental car? What about Dodges extended warranty, I bought the 5year 100K mile extended warranty that they offered. Doesn't that allow for a rental car?

You might check your local laws but here in Arkansas is you take a vehicle in for the same waranty repair 3 times and they can not fix it they have to give you a new vehicle. It's called a lemon law. I don't know if it realy works the way ist worded because I have never used it but I did some research on it because I had to take my truck in about 5 times in the first couple of months and was really starting to get pissed. But since it was alays a different problem I have had to just deal with the POS till I can trade it in.

Seems to me that the mechanic would sit in the vehicle while someone drenched the sunroof to find the actual leak before he attempted to repair it. Then check it again the same way prior to releasing the vehicle to the owner.

Yes Stroker your right, I called Dodges customer service and they told me that after 3 attempts the lemon law comes into affect. I told the guy I didn't want another truck unless they could get me the exact same thing. Besides that I already have the windows tinted, spray in bed liner and nerf bars installed.

After the dealer having the truck all day they are unable to get it to leak. I guess I under estimated someones ability to spray water on a truck. I was told to come pick up the truck. So I told them to have it sitting out with a water hose ready for me to test it. Only problem is that it takes me 1 1/2 hours to get there.

Any ideas?

thats bs, i would unbolt the steps and keep em, and tell them to just get u another truck, cause i think a whole new truck aside from the few hundred on line x and tint u prly find it would be worth it.?

here is a quote from the TX statute:

"§ 2301.605. Rebuttable Presumption—Reasonable Number of Attempts

(a) A rebuttable presumption that a reasonable number of attempts have been undertaken to conform a motor vehicle to an applicable express warranty is established if:

(1) the same nonconformity continues to exist after being subject to repair four or more times by the manufacturer, converter, or distributor or an authorized agent or franchised dealer of a manufacturer, converter, or distributor and:

(A) two of the repair attempts were made in the 12 months or 12,000 miles, whichever occurs first, following the date of original delivery to the owner; and

(B) the other two repair attempts were made in the 12 months or 12,000 miles, whichever occurs first, immediately following the date of the second repair attempt;

(2) the same nonconformity creates a serious safety hazard and continues to exist after causing the vehicle to have been subject to repair two or more times by the manufacturer, converter, or distributor or an authorized agent or franchised dealer of a manufacturer, converter, or distributor and:

(A) at least one attempt to repair the nonconformity was made in the 12 months or 12,000 miles, whichever occurs first, following the date of original delivery to the owner; and

(B) at least one other attempt to repair the nonconformity was made in the 12 months or 12,000 miles, whichever occurs first, immediately following the date of the first repair attempt; or

(3) a nonconformity still exists that substantially impairs the vehicle's use or market value and:

(A) the vehicle is out of service for repair for a cumulative total of 30 or more days in the 24 months or 24,000 miles, whichever occurs first, following the date of original delivery to the owner; and

(B) at least two repair attempts were made in the 12 months or 12,000 miles following the date of original delivery to an owner.

(b) A period or a number of days or miles described by Subsection (a) is extended for any period that repair services are not available to the owner because of:

(1) a war, invasion, or strike; or

(2) a fire, flood, or other natural disaster.

(c) The 30 days described by Subsection (a)(3)(A) do not include any period during which the manufacturer or distributor lends the owner a comparable motor vehicle while the owner's vehicle is being repaired by a franchised dealer"

There is the 4, 2, 1 rule...

4 repairs for the same problem or 2 repairs where the problem causes a hazard, or the vehicle is out of commision for more than 30 days.

All you have to do to claim the lemon law and demand a buyback or exchange is to write a letter to the manufacturer (there is a form letter on the TX dot website, sned the state a certified copy and show up for your court date.
