In June some guy backed into my GTO in the bank parking lot while I was getting some cash. I wasn't in the car and it was parked legally in a marked spot. To top it off I saw the guy hit the car and had to run after him to get him to stop. We traded information and his insurance paid for everything. Here is where it gets messed up. I get my insurance renewal in the mail the other day. It has an attached form that states I have 3 points on my driving record because of this accident. How in the hell can they put points on my driving record when I wasn't even in the car. It was legally parked, off, locked with no one in it and the alarm set. I am hoping it was just a mistake on the DMV's part, but also know NOTHING is easy when it comes to the DMV. Monday I will have to try and find out what the deal is. Has this happened to anyone else?????

It was farmers at the time, but the guy didn't call my insurance company. He didn't even take my info. He claimed full responsibility to his insurance and they paid. Think he was afraid I'd call the police because he tried to run. I was pretty pissed and in his face when I caught him.

The only way you can really get 3 points if you got a ticket that said you were driving carelessly or wrecklessly, which you were obviously not even in your vehicle.
I had a guy hit me one time and after we exchanged everything he lied to his insurance company and said I hit him, altho I never received any points. I would definitely be sitting at the DMV when they open Monday. Good luck.

You can count on that...lol. I might even set up a tent. I'm curious if it is just showing that way in the insurance database and not DMV's, but I'm not willing to let it go either way. I feel since I wasn't in the car and the guy admitted to his agent (as stated by his agent over the phone to me)that he was at fault that I shouldn't have any marks anywhere period. I'll let you guys know what happens on monday just in case it happens to someone else.

That really sucks, hope you scared the crap out of the dude who tried to hit and run.

I had a Nissan pickup that was pretty new and I hit a pole in a parking lot, private property, right? Well, I turn in the claim to my ins. co. they make me fill out an accident report before they process the claim and submit to DMV, I was charged with one point. My argument was that this happened on private property, not on the public street.....how do I get charged with a point? I was never given a ticket. They said anytime you have a claim for over $500 they submit to the DMV if there was no police report.

Hate to steal this thread but what kind of GTO was it? I am looking into an LS2 2006 GTO and want to know if you're happy with it. PM me please to prevent this thread from backing up. God, my friend has a black one with red interior and thats what I want....okay enough of the ADD ****. Sorry to hear about your mishap, let us know how it goes.

The issue is not with the DMV, it is with your insurance carrier. Most states have a very low dollar threshold when you have to report the accident. In New Jersey it is $500.00 or if an injury occurred. The only way the DMV gets the information is from a police incident report or from an individual filing a report. Most do not file a report for a minor (still big bucks) claim so it does seem odd that a guy who tries to run would follow these rules unless his agent told him he should.

The good news. The insurance carrier gets your transcript on a regular basis and the incident is only recorded as "involved in a MVA." with no blame attached. Take any and all documentation to your agent, the voucher from the other guy's insurance company showing you were paid in full should be enough. Things are really screwed up here in NJ, but this is easy to fix. Your agent is making good money from you, make him earn it.

I saw you have an Auburn LSD, any issues and did you replace the peg leg or the Chrysler LSD?

Remenber, if you did not have the bad days, how would you know how good the good day were.

Unfortunately I have to put the DMV visit off until tuesday now due to work schedule. I will however talk to my insurance agent. My old insurance agent told me to turn in the DMV paperwork myself. Don't know how it worked out to 3 points against me. Mike, hows the tires working out for you? So far the 20's are great. Wanderer, I love the Auburn as it was purchased to get rid of the peg leg and did just that. It's only been in for a month or two, but no problem thus far.
