Stuck in 4th gear

I'm confused. I thought that the transmission would be stuck in ERS (4) and the EVIC would show the numeral "4". ERS (4) is actually the first overdrive gear, not second gear as highlighted below.

Transmission Limp Home Mode
Transmission function is monitored for abnormal conditions.
If a condition is detected that could result in
transmission damage, the Transmission Limp Home
Mode will be engaged. In this mode, the transmission
will remain in the current gear until the vehicle is
brought to a stop.
To reset the transmission, use the following procedure:
1. Stop the vehicle.
2. Move the shift lever to the PARK position.
3. Turn OFF the engine and be sure to turn the key to the
LOCK position.
4. Wait approximately 10 seconds, then restart the engine.
5. Move the shift lever to the desired gear range.
If the problem is no longer detected, the transmission will
return to normal operation. If the problem persists,
PARK, REVERSE, and NEUTRAL will continue to operate.
Only second gear will operate in the DRIVE position.
Have the transmission checked at your authorized dealer
as soon as possible.

I have that same problem been to dealer many time first they try to say it was after market remote starter but after disconnecting it problem came back then they replace PCM 4 months later problem came back now they want to remove trans replace pump and filter not happy about that .I think it is a control problem not a hardware the trans work fine when not in limp home mode .If anyone has been cured or thru same trouble shoot with dealer please feel free to contact me at my email artsoa@juno.com I really dont want the trans pulled

I had the same problem with my 09 Hemi. It was back to the stealership four times in the first month that I owned the truck. Three of the four times I pulled it into the service lane stuck in fourth. The first three times the fix was to merely re-flash the truck. The fourth time I got Chrysler involved (Lemon Law time). This time around they replaced the PCM. 1200 miles later the problem seems to be corrected.
I have read other posts on Dodge websites from folks with this same issue. Replacing the PCM seems to be the ultimate fix for all of us. It's just a shame that it tales a couple of trips to the dealer with a brand new truck, with what is apparently a known problem, to resolve the issue. Other than that, with 2300 miles on the clock, this is the nicest truck that I've ever owned (I've had Fords, one Chevy, and a Gen 3 Ram).

If any one has gone to the end with this problem please feel free to contact me I will be glad to hear the step that you have gone thru I have PCM replaced and now they are throwing a trans pump at it i would rather not have the trans broke into for the pump if that not fixin it so any other idea are welcome!

I could find no service bulletin outlining the problem that you are having. If the dealer is unable to correct the problem on your vehicle I would suggest calling the Chrysler Customer Assistance Center so they can get the Chrysler techs involved with your issue. The assistance center and the Chrysler techs can work with your dealership to help get the issue corrected. Numbers below.
